Conditions Terms and Conditions

Article 1Scope

These General Terms and Conditions of Sale (GTCS) govern any order placed on the online shop. njoy-genius-car.ch. Any order implies full and complete acceptance of these T&Cs, which take precedence over any other conditions. N'Joy Genius Car reserves the right to modify them at any time; the applicable version is the one in force on the day of the order. They exclusively govern the Sale of products via the online shop; repair, exchange and retrofit services are subject to distinct conditions: our Conditions of cover and repair.

Article 3Products

The shop offers electronic and multimedia parts and systems (new and/or refurbished) for vehicles from the VAG (Volkswagen, Audi, Seat, Škoda…) and Porsche groups. Photos and descriptions are for guidance only. The Compatibility with the vehicle (part number / VIN) remains to be checked by the customer; if in doubt, contact us before ordering.

Article 4Price

Prices are shown in Swiss francs (CHF), VAT 8.1 % included, excluding delivery charges. Any shipping fees will be indicated separately and displayed before final order confirmation. N'Joy Genius Car reserves the right to modify its prices at any time, with the applicable price being the one displayed at the time of the order.

Article 5Order

The sales contract is concluded upon receipt of the order confirmation. N'Joy Genius Car reserves the right to refuse or cancel any order for good cause (stockout, manifest pricing error, serious doubt regarding compatibility or solvency), with the customer being informed and reimbursed if applicable.

Article 6Payment

Payment is made securely via the platform Saferpay (Worldline) — TWINT, Visa, Mastercard, PostFinance — or by Bank transfer / QR-bill. The order will only be processed once payment is confirmed (or, for bank transfers, once funds are received).

In accordance with Art. 715 CO, the goods remain the Property of N'Joy Genius Car until full payment of the price.

Article 7Delivery & Collection

Deliveries can be made to Switzerland, or can be Collected from the workshop de Duillier (by appointment). Delivery times are indicative; a delay cannot justify the cancellation of the order or give rise to compensation. The risks are transferred to the customer upon handing over the goods to the carrier or upon collection.

Article 8Return

There is no legal right of withdrawal for online purchases in Switzerland. As a commercial gesture, returns are possible. within 14 days, after prior agreement, for an article new, unused and in original packaging. Excluded from return:

• the parts specially ordered for the customer; ;
• Electronic components already installed, coded or paired to a vehicle.

Return costs are the responsibility of the customer, unless we have made an error.

Article 9Guarantee

The new products benefit from a 24-month warranty against defects (Art. 197 et seq. CO). Refurbished or used products benefit from a 12-month warranty, unless otherwise stated on the product specifications. The warranty does not cover normal wear and tear, incorrect installation, improper use, or damage caused by the customer or a third party. Any claims must be reported immediately to info@njoy-genius-car.ch mentioning the order number.

Article 10Self-install kits

N'Joy Genius Car offers OEM kits (Original manufacturer's options) which the customer can choose from'install it himself, with or without programming carried out by N'Joy. These sales are subject to the following conditions, supplemented by the Self-installation agreement accepted before sale.

• 24-month warranty on materials. The warranty covers exclusively the Equipment provided. It does not cover ni la pose carried out by the customer or a third party, nor the resulting damage, adjustments or malfunctions.
• Compatibility. The compatibility of the kit with the vehicle is checked based on the VIN (and, where applicable, the PR code) provided by the client. Any erroneous or incomplete information is the responsibility of the client.
• Programming. When the kit requires coding, this is carried out by N'Joy (pre-coded dongle by VIN, on-site or remote). No operation flash is not performed remotely. Correct hardware installation by the customer is a prerequisite for coding.
• Return. A kit open, mounted or programmed neither exchanged nor refunded.
• Help. Assistance (telephone/message) is available during installation as per the agreed terms. This does not constitute a guarantee of the result of the installation carried out by the customer.

The customer remains solely responsible for any work carried out on their vehicle. If in doubt, N'Joy recommends entrusting the installation to its workshop (complete tested and guaranteed installation).

Article 11Responsibility

N'Joy Genius Car's liability is limited to the value of the order in question. N'Joy Genius Car accepts no liability for indirect damages, nor for those resulting from installation by the customer or a third party.

Article 12Personal data

The personal data provided during an order are processed in accordance with our Privacy Policy, in compliance with Swiss data protection legislation.

Article 13Governing law and jurisdiction

These T&Cs are subject to the Swiss law. Any dispute relating to an order shall fall under the exclusive jurisdiction of the courts of Canton of Vaud (N'Joy Genius Car seat), subject to an imperative appeal and recourse to the Federal Court.
